End User License Agreement

This End User License Agreement ("EULA" or "Agreement") is a legal agreement between you ("you," "your," or "User") and Arbor Culture JH Services LLC ("we," "us," "our," or "Arbor Culture") governing your download, installation, access to, and use of Gem of Luck (the "Application"), including any updates, upgrades, features, content, documentation, or related services made available through the Application.

Please read this Agreement carefully before downloading, installing, accessing, or using the Application. By downloading, installing, accessing, or using the Application, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree to this Agreement, you must not download, install, access, or use the Application.

1. Purpose of the Application

Gem of Luck is a single-player idle gem-mining game for Android: you tap to dig for coins, find gems, upgrade tools, fill a vault, and prestige for permanent multipliers. The Application is intended solely for the purposes described above and for lawful use.

The coins, gems, crystals, and other values displayed in the Application are part of the simulated gameplay only. They have no monetary value, cannot be purchased, and cannot be exchanged for money or anything of value. Any game-style mechanics, graphics, or terminology are simulated and provided solely for entertainment.

2. License Grant

Subject to your compliance with this Agreement, Arbor Culture JH Services LLC grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to download, install, and use the Application on a compatible device that you own or control. The license is granted solely for personal use, lawful use, non-commercial use, and entertainment purposes.

The Application is licensed, not sold. This Agreement does not transfer ownership of the Application or any intellectual-property rights to you. All rights not expressly granted under this Agreement are reserved by Arbor Culture JH Services LLC and its licensors.

3. Eligibility

You may use the Application only if you satisfy the minimum-age requirements applicable in your jurisdiction for downloading and using applications of this kind. By using the Application, you represent and warrant that you satisfy the applicable minimum-age requirement, that you have legal capacity to enter into this Agreement, and that your use of the Application is permitted under the laws applicable to you. The Application is not directed to children.

4. Simulated Values

The Application does not operate a real-money system of any kind. The coins, gems, and crystals shown in the Application:

• are part of the simulated gameplay experience;
• have no real-world monetary value;
• cannot be purchased from us;
• cannot be sold, withdrawn, transferred, or redeemed for money or goods;
• do not constitute property; and
• do not create any payment obligation.

The Application should not be considered a gambling operator, casino operator, sportsbook, lottery operator, financial platform, or payment service.

5. Third-Party Content

The Application may display or link to content provided by third parties, such as the legal pages loaded from our website. Unless expressly stated otherwise, we do not own, operate, or control independent third-party services, and they may be subject to separate terms, license agreements, privacy policies, or technical requirements. You are responsible for reviewing any applicable third-party terms before using third-party content.

6. License Restrictions

Except where expressly permitted by applicable law, you must not copy, reproduce, distribute, sell, rent, lease, or sublicense the Application; commercially exploit, modify, adapt, or translate it; create unauthorized derivative works; reverse engineer, decompile, or disassemble it; attempt to derive source code; bypass authentication or security controls; disable technical protections; circumvent geographic restrictions; remove proprietary, copyright, or trademark notices; access non-public portions of the Application without authorization; or use the Application in a way that violates applicable law.

Nothing in this section limits rights that cannot lawfully be restricted under applicable law.

7. Prohibited Use

You must not use the Application to violate any applicable law; facilitate illegal activity; distribute malware or malicious code; conduct a cyberattack; interfere with servers or networks; gain unauthorized access to systems; exploit security vulnerabilities; impersonate another person; engage in fraud; interfere with another user's use of the Application; manipulate technical systems; attempt to misrepresent simulated gameplay as anything involving real money; or use the Application for an unauthorized commercial purpose.

8. Ownership and Trademarks

The Application and all original elements of the Application remain the property of Arbor Culture JH Services LLC or its licensors. Protected elements may include software, source code, object code, user interfaces, design, layout, graphics, icons, illustrations, text, branding, logos, trademarks, documentation, audiovisual content, and compilations.

Gem of Luck, related logos, branding, and design elements associated with us may be trademarks or trade names of Arbor Culture JH Services LLC. You may not use our trademarks without prior written authorization, except where applicable law permits such use. Third-party trademarks remain the property of their respective owners, and their appearance does not necessarily indicate endorsement, affiliation, sponsorship, or partnership.

9. Application Updates

We may provide updates, upgrades, patches, bug fixes, new versions, or other modifications to the Application. Updates may correct errors, improve performance, address security issues, add or remove functionality, modify existing features, or change compatibility requirements. Certain updates may be installed automatically depending on your device or application-store settings. We do not guarantee that any particular feature or previous version will remain available indefinitely.

10. Compatibility and Internet Connection

The Application may require specific devices, operating-system versions, or hardware capabilities. It is designed for Android phones running Android 7.0 or newer, in portrait orientation. We do not guarantee compatibility with every device or operating-system version.

The Application does not require an active internet connection for gameplay. Your save data is stored on your device. You remain responsible for your own internet access and any associated data charges where features use connectivity.

11. Application Store Terms

If you obtained the Application through Google Play, your use of the Application may also be subject to Google's applicable terms and policies. To the extent required by Google Play policies: this Agreement is between you and Arbor Culture JH Services LLC; Google is not responsible for the operation of the Application; support for the Application is provided by Arbor Culture JH Services LLC, unless otherwise expressly stated; and Google's terms continue to govern your relationship with Google.

We may determine the types of support provided, support availability, communication methods, response procedures, and supported versions of the Application. Unless otherwise required by law, we are not obligated to provide indefinite support for outdated versions.

13. Privacy

Our collection and processing of personal information associated with the Application are described in our Privacy Policy, available at https://gemofluck.com/privacy. You should review it before using the Application.

14. Data Deletion

Your game save and preferences are stored locally on your device and are not uploaded to us. You can erase them by uninstalling the Application or by using the reset option in its Settings. You may also request deletion of personal information we can reasonably associate with you by contacting rosawilliams199165@gmail.com, subject to applicable legal exceptions.

15. No Purchase Required

No purchase is required to access the functionality made available through the Application. The Application contains no in-app purchases, no subscriptions, and no advertising, and does not require the purchase of any virtual currency or gameplay credits. If we later introduce paid functionality, it may be governed by additional terms disclosed before purchase.

16. User Feedback

If you provide comments, suggestions, ideas, feature requests, bug reports, or other feedback ("Feedback"), you grant Arbor Culture JH Services LLC, to the extent permitted by law, a worldwide, perpetual, irrevocable, royalty-free, non-exclusive right to use that Feedback for purposes including improving the Application, developing new functionality, addressing bugs, and conducting internal research. You are not required to submit Feedback. This section does not override privacy rights applicable to personal information contained in Feedback.

17. Open-Source Software

The Application includes software components distributed under open-source licenses. Those components remain subject to their applicable open-source license terms. Where an open-source license grants rights that conflict with restrictions in this Agreement, the applicable open-source license controls with respect to that component.

18. Service Availability and Changes

We do not guarantee that the Application will always be available. Availability may be affected by maintenance, software errors, third-party service interruptions, security events, application-store decisions, legal restrictions, compatibility changes, force majeure events, or discontinuation of the Application. We may temporarily or permanently modify, suspend, or discontinue portions of the Application where permitted by applicable law. Content and features may be added, removed, replaced, modified, or restricted over time, and you do not acquire a permanent right to access any particular piece of content or feature.

19. Technical Malfunctions

The Application may experience technical problems including crashes, freezes, loading failures, display errors, interrupted sessions, or incorrect counters. Because the Application does not provide money, monetary prizes, or redeemable virtual value, technical errors do not create an entitlement to compensation, reimbursement, prizes, cash, credits, replacement value, or other monetary claims. We may correct, reset, remove, or modify technical errors.

20. No Warranty

To the maximum extent permitted by applicable law, the Application is provided "AS IS" and "AS AVAILABLE." Arbor Culture JH Services LLC disclaims, to the maximum extent permitted by law, express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, reliability, compatibility, security, and uninterrupted operation. We do not guarantee that the Application will be error-free, will work on every device, or that all defects will be corrected. Mandatory consumer warranties that cannot legally be excluded remain unaffected.

21. No Guarantee of Gameplay Results

We make no warranty regarding gameplay outcomes. We do not guarantee particular results, specific gem-find frequencies, particular game behavior, or any specific probabilities. Gameplay outcomes are intended solely for entertainment.

22. Limitation of Liability

To the maximum extent permitted by applicable law, Arbor Culture JH Services LLC, its affiliates, officers, directors, employees, contractors, licensors, and service providers will not be liable for indirect, special, incidental, consequential, exemplary, or punitive damages arising from or relating to your use of the Application, inability to use the Application, loss of data, interrupted gameplay, device incompatibility, technical errors, unauthorized access, or reliance on information made available through the Application.

Game balances, counters, outcomes, and gameplay sessions have no monetary value, and their loss does not constitute a financial loss. To the maximum extent permitted by applicable law, our total aggregate liability arising from or relating to this Agreement or the Application will not exceed the amount you directly paid to Arbor Culture JH Services LLC for the Application during the twelve months preceding the event giving rise to the claim; because the Application is free of charge, the minimum liability required by applicable law will apply where liability cannot otherwise be excluded. Nothing in this Agreement excludes liability where exclusion is prohibited by applicable law.

23. Consumer Rights

Nothing in this Agreement excludes, restricts, or modifies rights that cannot lawfully be excluded under applicable consumer-protection law. If mandatory consumer law applies to you, those rights remain effective notwithstanding any inconsistent provision of this Agreement.

24. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Arbor Culture JH Services LLC and its affiliates, directors, officers, employees, contractors, representatives, and licensors from claims, losses, liabilities, damages, and reasonable costs arising from your unlawful use of the Application, your material violation of this Agreement, infringement of another person's rights by you, or malicious or fraudulent use of the Application. This provision does not apply to the extent prohibited by mandatory consumer law.

25. Termination

You may terminate this Agreement at any time by ceasing use of the Application and uninstalling it from your devices.

We may suspend or terminate your license to use the Application where reasonably necessary because of violation of this Agreement, illegal activity, abuse of the Application, attempted security breaches, fraudulent activity, interference with our infrastructure, intellectual-property infringement, legal requirements, or discontinuation of the Application. Where required by applicable law, appropriate notice will be provided.

When this Agreement terminates, your license ends, you must cease unauthorized use, and provisions that by their nature should survive termination — including provisions regarding intellectual property, ownership, warranties, limitations of liability, dispute resolution, governing law, and accrued legal rights — remain effective.

26. Changes to the Application and This Agreement

We may change the Application at any time, including interface updates, new or removed features, compatibility changes, technical and security modifications, branding changes, or changes required by application stores or law.

We may update this Agreement periodically to reflect Application changes, legal requirements, regulatory developments, security requirements, application-store policies, or changes to our business operations. The "Last Updated" date indicates when this Agreement was most recently revised. Where applicable law requires notice of material changes, we will provide appropriate notice, and where consent is legally required for an amendment, we will request it. Continued use of the Application after an updated Agreement becomes legally effective constitutes acceptance to the extent permitted by applicable law.

27. Export and Sanctions Compliance

You may not use, export, re-export, or transfer the Application in violation of applicable export-control laws, trade restrictions, economic sanctions, embargoes, or other applicable international trade requirements. By using the Application, you represent that your use is not prohibited under applicable sanctions or export-control laws.

28. Governing Law and Dispute Resolution

This Agreement is governed by the laws of the jurisdiction in which Arbor Culture JH Services LLC is established, without regard to conflict-of-law principles, except where mandatory law requires a different result. If you are a consumer, nothing in this section deprives you of mandatory legal protections available in your country or region of residence.

Before initiating formal legal proceedings, you and Arbor Culture JH Services LLC are encouraged to attempt to resolve disputes informally. You may contact us at rosawilliams199165@gmail.com. Unless mandatory law provides otherwise, disputes arising from or relating to this Agreement or the Application will be subject to the competent courts of the jurisdiction in which Arbor Culture JH Services LLC is established; where applicable law provides consumers the right to bring proceedings in their place of residence, that right is not limited.

29. Force Majeure, Assignment, Severability, and No Waiver

To the extent permitted by law, we are not responsible for failures or delays caused by circumstances outside our reasonable control, including natural disasters, war, government action, internet or electricity failures, telecommunications outages, hosting-provider failures, third-party infrastructure failures, cyberattacks, epidemics, labor disputes, or similar events.

You may not assign or transfer this Agreement or your license without our prior written permission, except where applicable law provides otherwise. We may assign or transfer this Agreement as part of a merger, acquisition, restructuring, financing, sale of assets, corporate reorganization, or transfer of the Application or related business, subject to applicable law.

If any provision of this Agreement is found to be unlawful, invalid, or unenforceable, it will be interpreted or modified to the minimum extent necessary to make it enforceable where legally possible; if that is not possible, it will be severed and the remaining provisions will continue in effect. Failure by Arbor Culture JH Services LLC to enforce a provision does not waive our right to enforce it later, and no waiver is effective unless legally valid under applicable law.

30. Entire Agreement and Relationship With the Terms

This Agreement, together with our Terms and Conditions, Privacy Policy, applicable application-store terms, and any additional terms expressly presented for specific features, constitutes the agreement governing your use of the Application. If there is a conflict between this Agreement and feature-specific terms, the more specific terms will apply to that feature to the extent of the conflict.

This Agreement primarily governs the license granted to you to use the Application; our Terms and Conditions govern broader use of the Service. Where this EULA and the Terms address the same matter, they should be interpreted consistently wherever reasonably possible.

31. Language and Electronic Acceptance

This Agreement may be translated into multiple languages. The controlling language will be English, to the extent permitted by applicable law. Mandatory local-law requirements remain unaffected.

Your electronic acceptance of this Agreement has the same legal effect as acceptance in writing to the extent permitted by applicable law. Acceptance may occur through downloading or installing the Application, accessing it, or continuing to use it after being presented with this Agreement.

Important Entertainment-Only Disclosure

Gem of Luck is a simulated entertainment application. Users cannot wager money, deposit money for gameplay, withdraw money, receive cash winnings, win real-world prizes, purchase or redeem virtual currency, exchange gameplay results for money, or cash out simulated outcomes. Simulated gameplay outcomes have no monetary value, and success in the game does not imply, predict, or guarantee success in real-money activities of any kind. Use of the Application is subject to the minimum-age requirements stated in this Agreement.
