These Terms and Conditions ("Terms") govern your access to and use of Gem of Luck, the gemofluck.com website, and any related applications, websites, features, content, services, or functionality that link to these Terms (collectively, the "Service").

The Service is operated by Arbor Culture JH Services LLC, referred to in these Terms as "Arbor Culture," "we," "us," or "our."

Please read these Terms carefully before accessing or using the Service. By downloading, installing, accessing, browsing, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.

1. About the Service

Gem of Luck is a single-player idle gem-mining game for Android: you tap to dig for coins, find gems, upgrade six tools, fill a vault, and prestige for permanent multipliers. The gemofluck.com website describes the game, offers support contact, and hosts the legal documents.

The Service may allow users to browse available content and features, view information about the game, access informational content, and contact support. The exact features of the Service may change over time.

2. Simulated Gameplay and No Monetary Value

Gem of Luck is a simulated entertainment game. The coins, gems, crystals, boosts, perks, and other values displayed in the game are part of the simulated experience only. They:

• have no monetary value;
• cannot be purchased from us;
• cannot be redeemed for money;
• cannot be withdrawn or transferred;
• do not constitute property;
• do not represent a financial balance; and
• do not create any entitlement against Arbor Culture JH Services LLC.

Nothing available through the Service constitutes an offer to participate in gambling, betting, wagering, lotteries, financial trading, or any other activity involving the risk of money or property.

3. No Purchase Required

To the extent permitted by law, you grant Arbor Culture JH Services LLC a worldwide, perpetual, irrevocable, non-exclusive, royalty-free right to use, reproduce, modify, incorporate, develop from, publish, and otherwise use Feedback for the purpose of operating, developing, and improving the Service. This provision does not transfer ownership of personal information contained in your communications, which remains subject to our Privacy Policy.

Our collection and processing of personal information in connection with the Service are described in our Privacy Policy. By using the Service, you acknowledge that you have had an opportunity to review it.

12. Data Deletion

Your game save and preferences are stored on your device only. You can erase them by uninstalling the application or by using the reset option in its Settings. Users may also request deletion of personal information we can reasonably identify as belonging to them by contacting rosawilliams199165@gmail.com, subject to applicable law and legitimate retention requirements.

13. Service Availability and Changes

We aim to maintain the Service but do not guarantee continuous availability. The Service may become temporarily or permanently unavailable because of maintenance, software updates, technical errors, security incidents, legal requirements, platform requirements, force majeure events, or other circumstances. We may modify, suspend, restrict, or discontinue all or any portion of the Service at any time where permitted by applicable law.

Content and features may be added, removed, replaced, updated, modified, restricted, or discontinued. Your use of the Service does not give you a permanent right to access any particular feature.

14. Software Updates

15. Application Store Terms

If you download Gem of Luck through Google Play, your use of the application may also be subject to Google's terms. To the extent these Terms conflict with mandatory terms imposed by the application store, the mandatory store terms will apply to the extent of the conflict.

If you obtained the application through Google Play, you acknowledge that these Terms are between you and Arbor Culture JH Services LLC, not Google. Support for the application is provided by Arbor Culture JH Services LLC.

16. No Professional or Financial Advice

Information provided through the Service is intended for general informational purposes. Nothing available through the Service constitutes financial, investment, gambling, legal, or tax advice, or a recommendation to spend, wager, or invest money.

17. No Guarantee of Game Results

Gem of Luck involves simulated outcomes driven by chance within the game. We do not guarantee any particular game result, gem find, or frequency of lucky outcomes, uninterrupted gameplay, or the preservation of a particular session.

18. Game Malfunctions and Technical Errors

The application may occasionally experience freezes, crashes, display errors, loading problems, interrupted sessions, incorrect counters, or other technical errors. Because gameplay does not involve real money or redeemable value, a technical malfunction does not create an entitlement to payment, compensation, credits, currency, prizes, or other monetary value. We may reset, correct, remove, or discontinue technically defective content.

19. No Warranties

To the maximum extent permitted by applicable law, the Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the extent legally permitted, Arbor Culture JH Services LLC disclaims warranties and representations of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, security, compatibility, and uninterrupted operation. We do not warrant that the Service will always be available, will be error-free, will function on every device, or that defects will always be corrected. Some jurisdictions do not permit certain warranty exclusions, so some of these exclusions may not apply to you.

20. Limitation of Liability

To the maximum extent permitted by applicable law, Arbor Culture JH Services LLC, its affiliates, directors, officers, employees, contractors, representatives, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to the Service, including loss of use, loss of data, loss of business opportunity, interruption of service, device problems, third-party services, unauthorized access, reliance on Service content, or inability to access particular features.

Because the Service does not permit real-money wagering or provide redeemable virtual value, loss of a game result, score, counter, balance, or session does not constitute a financial loss recoverable from us. Where applicable law does not permit a particular exclusion or limitation of liability, that exclusion or limitation applies only to the maximum extent permitted by law.

21. Consumer Rights

Nothing in these Terms excludes, restricts, or modifies rights or remedies that cannot lawfully be excluded, restricted, or modified under applicable consumer-protection law. You may stop using the Service at any time. If you have installed the application, you may uninstall it from your device. Upon termination, your license ends and provisions intended by their nature to survive termination will remain effective.

25. Governing Law and Disputes

These Terms and any dispute arising from or relating to them will be governed by the laws of the jurisdiction in which Arbor Culture JH Services LLC is established, without regard to conflict-of-law principles, except where mandatory consumer law requires otherwise.

If you are a consumer, you may also retain mandatory rights and access to courts under the laws of your country or region of residence. Nothing in this section deprives consumers of protections that cannot legally be waived.

26. Force Majeure

To the extent permitted by law, we will not be responsible for failure or delay in performing obligations caused by circumstances outside our reasonable control, including natural disasters, war, civil unrest, government action, internet or electricity outages, telecommunications failures, hosting-provider failures, third-party infrastructure failures, cyberattacks, epidemics, labor disputes, or similar events.

27. Severability and No Waiver

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable where permitted; if modification is not possible, the affected provision will be severed and the remaining provisions will continue in effect.

Our failure to exercise or enforce a right under these Terms does not constitute a waiver of that right. A waiver is effective only where expressly made by us in writing or where otherwise legally binding.
